Federation of Haitian Chambers of Commerce Inc.
Effective Date: August 1, 2025
Welcome to fhccglobal.org. These Terms and Conditions (the “Terms”) govern your use of the website, member areas, forms, event calendar, and related online services operated by the Federation of Haitian Chambers of Commerce Inc. (“FHCC,” the “Federation,” “we,” “us,” or “our”). Please read them carefully.
1. Acceptance of These Terms
By visiting this website, creating an account, submitting a form, registering for an event, or applying for membership, you agree to these Terms and to our Privacy Policy. If you are acting on behalf of a chamber of commerce, business, or other organization, you confirm that you are authorized to accept these Terms for that organization. If you do not agree, please do not use the website.
2. About the Federation
The Federation of Haitian Chambers of Commerce Inc. is a Georgia corporation headquartered in Atlanta, Georgia. Launched on July 25, 2025, the Federation unites Haitian chambers of commerce from around the world into a global alliance of Haitian businesses and professionals. Our mission is to amplify our collective economic voice, foster transnational business opportunities, and build a sustainable future for Haitian chambers, entrepreneurs, professionals, and communities across the diaspora and in Haiti.
The Federation is a collaborative network, not a governing body over its member chambers. Each member chamber is an independent organization responsible for its own governance, finances, programs, members, and legal obligations. Nothing on this website, and no membership in the Federation, creates a partnership, joint venture, agency, or employment relationship between the Federation and any member chamber, partner, or user.
3. Eligibility
You must be at least 18 years old to create an account, apply for membership, register for an event, make a payment, or submit content through this website. Our services are intended for chamber leaders, business owners, professionals, partners, and members of the public interested in Haitian economic development.
4. Accounts and Member Areas
Some areas of the website, including the Member Dashboard, Member Video Library, project management tools, meeting notes, and internal forms, are available only to authorized member chambers, officers, committee members, and invited users.
- You agree to provide accurate, current information and to keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- Do not share your login with anyone, including others in your own chamber. Each person who needs access should request their own account.
- Notify us right away at hello@fhccglobal.org if you suspect unauthorized use of your account.
- Content in member areas, including recorded webinars, board meeting archives, toolkits, and internal documents, is provided for members’ internal use only. Do not download, record, republish, or distribute it outside your chamber’s leadership without written permission from the Federation.
- We may suspend or remove access when membership lapses, when a user’s role changes, or when these Terms are violated.
5. Membership
The Federation offers membership categories that include Full Member Chambers, Impact Partner Members, and Association Members. Eligibility, benefits, board representation, and voting rights for each category are described in our membership materials and governing documents, which control if they conflict with anything on this website.
- Applications. Submitting a membership application does not guarantee acceptance. The Federation reviews applications against its membership criteria and may accept or decline any application at its discretion.
- Dues. Membership dues are set by the Federation’s Board of Directors and may change from year to year. Unless the Board decides otherwise, dues are billed annually on each member’s membership anniversary date. Payment plans or discounts, when offered, will be described in your renewal notice.
- Benefits. Member benefits, such as the Cross Membership Program, Chamber Academy, Global Networking sessions, partner discounts, and trade mission opportunities, are offered as available and may be changed, added, or discontinued. Benefits provided by third-party partners are subject to those partners’ own terms.
- Representation. A member chamber may not state or imply that it speaks for the Federation, or that the Federation endorses a specific product, candidate, business, or position, without written approval from the Federation.
- Termination. Members may withdraw by written notice. The Federation may suspend or end a membership for nonpayment of dues or for conduct that conflicts with its mission, bylaws, or code of conduct, following the procedures in its governing documents. Dues already paid are not refundable unless the Board decides otherwise.
6. Events, Programs, and Payments
The Federation hosts and promotes events and programs, including Chamber Academy sessions, Global Business Connect networking, quarterly meetings, the Global Business Summit, trade missions, and ChamberStart Initiative cohorts.
- Registration. Some events require advance registration. Space may be limited, and registration is confirmed only when you receive a confirmation from us or our ticketing provider.
- Pricing and member access. Certain programs, such as Chamber Academy, are free for member chambers and available to non-members for a fee. Member codes are for the use of the member chamber they were issued to and may not be shared outside that chamber.
- Payment processing. Payments, dues, sponsorships, and donations are processed by third-party providers, including Zeffy and Stripe. The Federation does not store full payment card numbers. Your payment is also subject to the provider’s terms and privacy policy.
- Cancellations and refunds. All registration fees for paid events are final and non-refundable, including when you are unable to attend. You may transfer your registration to another person by notifying us before the event. If the Federation cancels an event, registered attendees will receive a credit toward a future Federation event. We are not responsible for travel, lodging, or other costs you incur.
- Changes. We may change event dates, times, formats (in person, virtual, or hybrid), speakers, or locations when necessary. We will make reasonable efforts to notify registered attendees.
- Trade missions and travel. Trade missions and international programs may be subject to separate agreements, eligibility requirements, and travel conditions. Participants are responsible for their own passports, visas, insurance, health requirements, and personal safety decisions, and should review current government travel advisories before traveling.
- Sponsorships. Sponsorship benefits, deliverables, and deadlines are governed by the sponsorship agreement or sponsorship package for each event. Sponsorship does not imply the Federation’s endorsement of the sponsor’s products or services.
- Tax status. The Federation’s application for recognition as a 501(c)(6) organization is pending with the IRS. Dues and payments to the Federation are not deductible as charitable contributions for federal income tax purposes, though they may be deductible as ordinary business expenses. Please consult your tax advisor.
7. Photography, Video, and Recordings
Federation events, including virtual sessions, may be photographed, filmed, or recorded. By attending or participating, you grant the Federation permission to use your name, image, likeness, voice, and comments, without compensation, in Federation communications, including this website, newsletters, social media, the Member Video Library, and promotional materials, and in materials shared with media partners such as The Haitian Times. If you prefer not to be photographed, please tell event staff at check-in, or keep your camera off in virtual sessions, and we will make reasonable efforts to accommodate you. You may not record Federation meetings or sessions yourself without our permission.
8. Submissions and User Content
The website lets members, chambers, and the public submit content, including community events for the FHCC Event Calendar and World Cup Hub, announcements, President’s Corner profiles, membership and committee applications, expense and reimbursement forms, bylaws amendment submissions, and other forms (together, “User Content”).
- Your responsibility. You are responsible for the accuracy of your User Content. Include clear dates, times, locations, and a point of contact for any event or announcement.
- Your rights. You must own or have permission to use everything you submit, including logos, flyers, photos, headshots, and graphics. Do not submit content that belongs to someone else without their consent.
- License to the Federation. You keep ownership of your User Content. By submitting it, you grant the Federation a non-exclusive, royalty-free, worldwide license to use, reproduce, edit for clarity and length, display, and distribute it on this website and through Federation channels, including our newsletter, WhatsApp community, social media, and partner outlets such as The Haitian Times, which draws from the FHCC Event Calendar.
- Review and moderation. All public submissions are reviewed before publication. The Federation may edit, delay, decline, or remove any submission at its discretion, including content that does not align with our mission or membership guidelines. Please submit announcements at least two weeks before the date you want them featured.
- No endorsement. Publishing an event, announcement, or opportunity is not an endorsement by the Federation. We do not verify every detail of third-party events and are not responsible for events we promote but do not host.
- Personal information about others. Only submit another person’s information, such as a chamber president’s birthday, bio, or headshot, if that person has agreed to share it with the Federation.
- Internal forms. Expense reports, reimbursement requests, and similar forms are Federation records. Submitting one does not guarantee approval or reimbursement. Approval follows the Federation’s financial policies and requires the documentation those policies call for, such as itemized receipts.
9. Intellectual Property
The website and its content, including text, graphics, the FHCC name and logo, page designs, toolkits, templates, certificates, presentations, videos, and other materials, are owned by or licensed to the Federation and are protected by copyright, trademark, and other laws.
- You may view and print pages for your personal or internal organizational use.
- Member chambers may use materials from the Chamber Leadership Toolkit and Chamber Academy within their own organizations, and may adapt templates for their chamber’s use. Republishing or selling these materials, or presenting them as your own work outside your chamber, requires written permission.
- Member chambers may display the FHCC name and logo to show their membership, following the FHCC Brand Guidelines. Any other use of the FHCC name or logo, including on merchandise, sponsorship materials, or co-branded events, requires written approval from the Federation.
- Logos and trademarks of member chambers, partners, and sponsors shown on this website belong to their respective owners and appear with permission.
10. Acceptable Use
When using the website, you agree not to:
- Submit false, misleading, defamatory, discriminatory, harassing, or unlawful content.
- Impersonate any person, chamber, or organization, or misrepresent your affiliation with the Federation.
- Use the website, member directory, or event attendee information to send unsolicited marketing or spam.
- Scrape, harvest, or collect information about members or users by automated means.
- Upload viruses or malicious code, or attempt to gain unauthorized access to the website, member areas, or other users’ accounts.
- Interfere with the operation or security of the website.
- Use the website for partisan political campaigning or in any way that would conflict with the Federation’s tax-exempt purpose.
- Use the website for any purpose that violates applicable law.
11. Third-Party Links and Services
The website links to and works with third-party websites and services, including payment processors, video conferencing platforms, member chamber websites, media partners, and resources such as the Haiti Digital Dashboard. The Federation does not control these services and is not responsible for their content, availability, privacy practices, or terms. Your use of them is at your own risk and subject to their terms.
12. Privacy and Communications
Our Privacy Policy explains how we collect, use, and protect the information you provide, including through forms, registrations, and member accounts. By submitting your email address or phone number, you agree to receive communications from the Federation, such as newsletters, event notices, renewal reminders, and WhatsApp community updates. You may unsubscribe from marketing emails at any time using the link in each message, or leave the WhatsApp community at any time.
13. Disclaimers
The website and its content are provided “as is” and “as available.” Information about business opportunities, trade missions, funding sources, grants, investment programs, and government resources is shared for general informational purposes only. It is not legal, tax, financial, investment, immigration, or other professional advice, and you should consult a qualified professional before acting on it. The Federation does not guarantee any business outcome, funding, contract, or investment result from participating in its programs, and does not vet or endorse the businesses, products, or services of its members, partners, or sponsors. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components.
14. Limitation of Liability
To the fullest extent permitted by law, the Federation, its officers, directors, committee members, volunteers, member chambers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities, arising from your use of the website, its content, or Federation programs and events. Our total liability for any claim related to the website will not exceed the amount you paid to the Federation in the twelve months before the claim, or one hundred U.S. dollars ($100), whichever is greater.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Federation and its officers, directors, volunteers, and partners from any claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising from your User Content, your violation of these Terms, or your violation of any law or the rights of another party.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules. Before filing any claim, you agree to contact us first and try to resolve the dispute informally for at least thirty (30) days. Any legal action that cannot be resolved informally will be brought in the state or federal courts located in DeKalb County, Georgia, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the website after changes are posted means you accept the updated Terms.
18. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, membership materials, and any event or sponsorship agreements, are the entire agreement between you and the Federation about your use of the website. Where these Terms conflict with the Federation’s bylaws on matters of membership or governance, the bylaws control.
